Justice Wakiaga Orders Admission of Jowie Irungu at KNH

The main suspect in the murder of businesswoman Monica Kimani on Tuesday earned a ruling setting him up for a journey so close to his freedom.

Justice James Wakiaga ruled that Jowie Irungu is admitted at the Kenyatta National Hospital or be released to seek treatment at a facility of his choice should the State fail to cater for his healthcare needs.

Wakiaga's decision comes a few days after KNH reportedly turned away Jowie and other inmates over a huge debt the prisons department had not settled with the hospital.

Jowie is believed to have shot himself in the shoulder, and his health has been the defence team's pillar in the pursuit for his release.

Through his lawyers, Irungu sought to have the state compelled to present him for treatment at the Kenyatta National Hospital. He was recently rejected by the facility over the Kshs31 million debt owed by the prisons department.

Jowie was to be admitted to the referral hospital’s Ward 6A for an operation in mid-November but he was turned away.

Justice Wakiaga's ruling came shortly after Irungu dropped his application for Justice Wakiaga to recuse himself from the murder case.

Irungu wanted Wakiaga to disqualify himself from the matter over the remarks he issued against him, describing him as a 'Woman Eater.'

On Tuesday, Jowie reconsidered his application saying he made the decision to seek Wakiaga's disqualification in a rush, asking the court to allow him to abandon the same.

Irungu's co-accused, Jacque Maribe, who had sued the prosecution and investigating officers for contempt of court, was granted access to her car and rental house in Lang'ata.

His car, mobile phone, sim-cards and sd-cards had been confiscated by the probing officers but she filed an application in which she also sought to be served with witness statements.
